Contra Costa Couple Sues Realtor and Registered Sex Offender for Fraudulent Concealment

21 May 2007 - San Francisco, CA: Jury selection began yesterday in a case certain to open dialogue on both sides of the emotionally charged issue of the public's right to know the identities and addresses of registered sex offenders. The case of Diaz vs. Giusti pits the Diaz family of Contra Costa County against registered sex offender Alfred Giusti and Diablo Realty.

"My clients would never have bought this house if they had known all the facts," said Attorney Drexel A. Bradshaw (www.bradshawassociates.com) who is representing the Diaz family against Alfred Giusti and Diablo Realty. "The sellers and their agents deliberately concealed Mr. Giusti's status as a registered sex offender in order to get a better price for the property."

Prior to their purchase of the house in December 2005, the Diaz family claims that Giusti and Diablo Realty purposefully hid Giusti's status as a registered sex offender: a fact that according to Bradshaw has led to substantial emotional distress and monetary loss on the part of the Diaz family.

"Mr. Giusti is a general contractor with specialized knowledge of electronic security systems in general and specifically with the system installed in the house now occupied by the Diaz family," says Bradshaw. "When my clients were made aware of this, they were forced to invest considerable financial resources installing a new security system."

Prior to the purchase of the home in question, the Diaz family had spent considerable time researching the online registration of sex offenders that was an outgrowth of "Megan's Law." Despite that fact that Giusti was required to register his home address with the "Megan's Law" website, no such registration was ever made at the time of the sale.

"This is fraud, pure and simple," stated Bradshaw. "Adding insult to injury is the fact that Giusti's victims were of the same age as the Diaz children."
