Baranco has ruled in favor of an Oakland resident who charged criminally negligent construction practices on the part of Skyline Construction with whom she had contracted to build an addition to her home so that she might expand her childcare business. The plaintiff, Vicki Martin, who was represented by San Francisco Attorney Drexel A. Bradshaw (www.bradshawassociates.com) and Helen Liu, was awarded $314,600.00 plus an additionally anticipated $300,000 in attorney’s fees and costs. Since then,the State of California has revoked Skyline’s license to do business. “This is a victory for homeowners defrauded and swindled by crooked contractors,” said Bradshaw, who has expertise in dealing with construction-defect cases. “The court found that Skyline Construction breached its contract with our client and did not act in good faith and fair dealing with her, ignoring her complaints and eventually walking off the job without completing it.” In 2004, Martin hired Skyline Construction and Home Improvements to construct an addition onto her home in Oakland so that she could expand her child daycare business. Skyline then hired a subcontractor, FP Construction, to perform the work. According to Bradshaw, not only was the construction of the addition performed poorly, but also in “reckless disregard of housing codes and building industry standards.” “Workers actually fell through the roof of the addition and did not patch the holes, causing rain to pour in,” said Bradshaw, noting that his client’s home not only suffered extensive water damage but also that the foundations of the addition did not meet flush with the existing structure. “This was the definition of shoddy and criminally negligent work.” Skyline Construction owners Rodney Andrews had previously pled guilty to felony diversion of funds and his wife Valerie pled guilty to a misdemeanor, all in connection with a similar scheme to defraud homeowners on home improvement projects.
