Notice to Class Members

On June 13, 2011, the Court entered an order granting Preliminary Approval to a settlement between all parties, as well as an award of attorneys’ fees and costs to Plaintiffs’ Counsel, Bradshaw & Associates, P.C. A copy of the order can be found here. The order found on a preliminary basis that the award to the class was fair and adequately compensated the class, and that the allocation of fees and costs was fair and reasonable because “a) as a significant benefit has been conferred on a class of persons; b) the issues presented in the underlying litigation were complex and novel, and Plaintiffs’ Counsel skillfully navigated those issues to achieve that benefit; c) Plaintiffs’ Counsel bore the risk in pursuing this litigation; and d) this is a fee shifting case where application of the “lodestar” method is appropriate.” The Court’s preliminary finding is subject to the filing of Plaintiffs’ Counsel’s written fee application, and any objections filed to the settlement or the fee application itself.
